So, a priest walks into a city council meeting — stop me if you’ve heard this one — and is nearly hauled away by the police for speaking calmly to his elected officials.

Father Nathan Monk wasn’t laughing at last night’s City Council meeting. During the Boyd Forum, an open comment period named in honor of the late civic activist LeRoy Boyd, Father Monk chided the council members — and Council President Sam Hall in particular — for their actions at Monday’s Committee of the Whole meeting. At that meeting, several citizens had spoken in opposition to the proposed anti-homeless ordinances, and in doing so made unflattering comparisons to historical figures (one person mentioned Heinrich Himmler’s “Final Solution“) and questioned the Christian charity of any council member who would support the ordinances. Council members DeWeese and Johnson took offense at the accusations, and Hall had asked Police Chief Chip Simmons to remove several speakers he deemed “out of order.”
At last night’s meeting, Monk told the council they had no right to dictate the content of their speech, and suggested that they instead examine any actions by the city that would prompt such comparisons.
“As Americans, we have the right to redress our government without fear of being arrested,” he said. “Whether or not they’re connecting dots from Hitler to George Wallace to Barney … you should be asking, ‘well what are we doing that’s allowing people to connect those dots?’ It was a sick and gross abuse of power.”
Council President Hall interrupted Monk at that point. “Your time is up, sit down,” he said.
“No, I have a minute and 12 seconds left,” Monk said, looking at the timer at the speaker’s lectern.
“I’m ruling you out of order,” Hall said.
When Monk refused to leave, noting that he had not violated any rules of conduct, Hall asked Police Chief Simmons and two other uniformed police officers in attendance to remove him. He refused to budge until his allotted time was up, after which he was escorted from council chambers by the officers.
During the standoff, council members Sherri Myers and John Jerralds stood up and left their seats in protest.
“I am leaving this chamber as you are in violation of the people’s First Amendment right,” Myers said. “I will be outside if you want to want to address your grievances to your government.”
Returning to her seat later in the meeting, she strongly criticized the “chilling effect” such censorship can have on the public right to speech.
Civility was a recurring theme at last night’s meeting. City Administrator Bill Reynolds spoke about lingering charter questions, like whether the mayor should attend council meetings or had authority to award employee bonuses, and said that there was a certain level of political rhetoric he considered inappropriate.
“It’s really unfortunate that the political disagreements and discussions that we will have get forced into venues that they simply don’t have a place,” Reynolds said. He added that when the mayor is making “a good faith effort” to help employees, “to suggest that somehow that action is criminal, that really is a little bit beyond the pale.”
The context behind this statement was a complaint lodged by former council member Diane Mack alleging that Mayor Hayward had acted illegally in awarding the bonuses. She requested an opinion from the State Attorney’s Office of whether the bonuses violated Sec. 9-3-24 of city code, which states that “No bonus shall be paid to any employee unless specifically authorized by the council.” Reynolds said they received the opinion yesterday, and that the State Attorney’s Office believed the mayor was within his authority:
The Charter for the City of Pensacola provides that the Mayor has the power to exercise the executive powers of the City and to supervise all departments including, but not limited to, the power to appoint, discipline, and remove all officers and employees. … [T]he City Charter provides that if a conflict exists between the provisions of the Charter and the Code of Ordinances, the Charter provisions control.
The mayor’s office issued a press statement about the opinion at around 5:00 yesterday afternoon, which Reynolds said he hoped would “bring an end to the debate,” but several council members said they had not heard about it before the meeting.
Councilman Johnson, who arrived late to the council meeting, said it didn’t seem like “the best use of our time to keep beating this horse.”
“We now have a State Attorney’s Office opinion that has been rendered supporting that decision,” Johnson said. “Let’s move on from that, and let’s start trying to find ways to grow this city.”

If Mike Wiggins had been elected, Rick Outzen & those who champion Mayor Hayward, would be screaming about this and other matters. If Wiggins refused to attend council meetings, if employees were terminated without cause & with no indication from the mayor that they had done anything wrong, if civil service had been abolished, etc. etc. I’m glad I made the great escape & am so sorry for those of you who remain in Pensacola. If Pensacola had a local news magazine focused just on city politics, the end-of-year cover page might be a big blank sheet of white paper and the words “The Year of the Non-Reader.” During the big PNJ mayoral candidate debate at First Baptist Church in 2010, each candidate was asked about the last “book” they had read. Ashton Hayward said, “The Wall Street Journal.”
For years, I have been stunned that Council Members knowingly vote on matters they do not understand. Reporters covering city hall have expressed to me similar shock that Council Members do not know what is going on and vote in the blind. Even the new City Attorney is in on the act routinely claiming in haste to have “seen” a legal document it is blindingly obvious he has not actually “read” let alone understands.
Being an “old school” reader, yesterday I reviewed the Rules and Procedures of the City Council. Section 2 President of City Council as Presiding Officer has one sentence that says, “The President of the City Council shall have control of the Council Chamber and the connecting hall and corridors, and in case of disturbance or disorderly conduct cause the same to be cleared.” Was Father Monk causing a disturbance or engaging in disorderly conduct? Clearly, he was not. Accordingly, it appears Sam Hall abused his power and violated the City Council’s own Rules and Procedures. Will the Council remove him from his office as their leader? Probably not.
Is there any other possible explanation? If you read on, Section 3 Order of Business says the “Time limit for public input may be changed at the discretion of the President of City Council.” The alternate theory is that Hall, who has told many people he plans to pursue a career in the ministry helping the poor after he leaves the Council at the end of 2012, was rattled at the sight of a man of God scolding him in public. The easiest way for Hall to make his conscience stop hurting was to eliminate the truthsayer Father Monk. Therefore, Hall may have changed the public input time limit just for Father Monk. Problem solved.
The big unasked question by anyone on the Council is by what authority Hall can direct the Chief of the Pensacola Police Department and his officers to do his bidding? Does the City Code give the Council President any other power to order the Chief of Police to do anything? If Mayor Hayward had been present, and he never is by design, and if Father Monk was violating a real law, as distinguished from The Law of Sam Hall, then we would all have thought it reasonable if Mayor Hayward had calmly asked Chief Simmons to escort Father Monk, or me, or anyone else from the Council Chambers.
As for this nonsense about the Charter and imaginary conflicts, it is all pretty sad. Hayward still claims, “The Charter made me do it” explaining away his desire to end merit protection for city employees by abolishing the Civil Service System. He knows multiple Charter Review Commission and Believe in A Better Pensacola political committee documents prove him a liar. No one from either group steps forward to tell the truth for fear of offending Hayward.
Now, adding to an already too long list of public wrongs directed against “our” Council who work for we the people, in theory, Hayward claims there is another secret conflict between the Charter and the City Code. The Charter was approved by voters on November 24, 2009. It became effective January 1, 2010. The Charter was the paramount law of the City from that day to the present.
I checked the City Code posted online at Municode and then the Council’s own records. On September 9, 2010, the Council approved Proposed Ordinance No. 13-10 on second reading. The subject was Amending the Code of the City of Pensacola to Reflect a Strong Mayor. (For the record, the phrases “Strong Mayor” and “Weak Council” never appear in the Charter.)
Section 9-3-24(5)(b) pertaining to Salary Adjustments was amended changing “city manager” to “mayor” as was done in every place within the City Code. More importantly, this sentence was removed – “Additionally, the city manager is authorized to approve performance based bonuses irrespective of the maximum pay of the range.” In its place, the Council substituted – “No bonus shall be paid to any employee unless specifically authorized by council.” Case closed.
I agree with Councilman Larry B. Johnson when he whines that it is not “the best use of our time to keep beating this horse.” I agree, the time for talk is over and it is time for action. Very clearly, Mayor Hayward broke both city law and state law. He is at least guilty of malfeasance or “official misconduct.” Hayward has injured the public good by taking money ($581,250) from the city treasury he had no authority to spend and giving it to city employees. I do not know what penalty the Council can impose on the Mayor but doing nothing tells me they just do not care.

The time limit may be changed however it has been noted in several other city charters that the time limit would be changed at the digestion of the mayor before the meeting or if too many people were speaking. What he is using that provision for is a disgusting censorship of the people and needs to be stopped.

Looks like an open and shut case against your Mr. Hall and the police, who are willing to trample on the First Amendment rights of the priest. Ever present in front of the camera when it’s a positive photo-op, the mayor and his cabinet are amazingly quiet. My ability to fully document what is happening in Pensacola is very limited (I live near Madison, WI). In watching the clips, so many people were cut off in trying to explain why they disagreed with the council (and what they felt the motivations were). So I was not able to get a full understanding. I am still trying to figure out the roll of big money in this and it would be fantastic to get a fuller picture from those “on the ground”

The mayor should want to attend the city meetings, whether he is required to attend or not should not be the focus.
The council should remove Sham Hall as council president unless the support his agenda. If they do not it will be a long year watching

The citizens then have the right to oppose, resist by any and all means necessary up to and including deadly force, any method being used to violate those rights. I am not a scholar of constitutional law, but I strongly advise you to check the case law on that “fact” before you go playing judge jury and executioner to any police officers.

I am correct, the law is in itself easily found all you have to do is LOOK. Other laws such as 42 U.S.C. 1983 allows not only an official lawsuit but a PERSONAL lawsuit against all parties involved, so if they are protected by their position they are not PERSONALLY, this will include their supervisors also. So police officer or not, if he’s without a doubt violating your rights or attempting to arrest you illegally YES you can resist by any means including deadly force…and it’s LEGAL.

Just because the city council commands them to harass this guy, they do it, even though he’s not breaking the law, AND therefore breaking the law themselves. This is one of the major reasons people are leaving Pensacola, home prices are dropping like a rock, and crime rates are going up. As this spreads through the national media today, these cops will get their “just due” when their illegal, priest harassing activities are rightly connected to their names forever…

Nathan Monk is so obviously in the right that this whole episode smacks of farce.
Not only does Sam Hall owe Mr. Monk and the entire city of Pensacola an apology, but the citizens of Pensacola owe it to themselves to examine their lack of ability in deciphering fatal character flaws in people BEFORE electing them.
Shameful stuff on the one hand and hopeful, due to the likes of Nathan Monk, on the other.

Notice how the reporter’s story and the headline writer’s headline were opposite. The Chairman of the Pensacola Council violated the law by censoring the priest because he didn’t like his statement. He is acting like a Corporatist Fascist.

Hey folks in Pesacola- this has gone national. Many people are reading this and have also viewed this on an online video of Pensacola President Hal…l violating Father Nathan Monk’s right to free speech. I’m writing this from Michigan and found out about it on Judge Andrew Napolitano’s “Freedom Watch.” Many are now posting it on Facebook and sending it out through their e-mail.
President Hall wrongly violated Father Nathan Monk’s right to speak by telling him he was out of order. Why no one spoke out who was in attendance that the Council President was himself “out of order” just amazes me. Has the Council President Hall become nobility in the mind-set of those who elected him?
Please tell me – does the council always have a “peace officer” sitting close to citizen’s lectern? Shades of a Police State!

(Following orders from an appointed authority) They didn’t get physical with Father Monk, although you could tell he was afraid they might. I am from Wisconsin and we’re going through all kinds of political turmoil at the moment. At least we still get out there and do something about it, even if the temperature is below freezing. I think it is sad, so sad when people overstep their authority as is the case of Mr Hall. I no longer live in Pensacola but it concerns me to see this. Mr. Hall clearly either does not know or does not CARE (guessing this one) that it was actually himself who was out of order for cutting of Father Monk before his alloted time was expired; I never saw/heard profanity, threats, violence or any action from Father Monk that would justify Mr. Hall’s action. I do commend the 2 council members who “stood up” FOR Father Monk rights and AGAINST Mr Hall. I was also saddened that three officers actually felt it might take all of them to follow Mr Hall’s dictate to remove Father Monk. Does Hall even have the authority to order the officers to do his bidding when there is clearly NO threat of harm or criminal action? At the very least, Mr Hall should CLEARLY apologize publicly for his offensive actions; ideally he should resign since it is obvious that he has no busines running a council meeting. And as much as I recognize the need for law enforcement officers to maintain the LAW, I think those officers’ superior should remind the officers who they “work” for – the public safety and protection of the public’s rights; not Mr Hall.

I agree with the homeless ordinance 100%. Frankly there is no reason for anybody to be homeless because there are tons of farms that need hands-since Americans don’t like to get their hands dirty we have a flood of ILLEGAL aliens doing it. Homeless people spread diseases and litter-and bad for businesses: They frighten customers away. HOWEVER, it is a shame and tragedy that the Council did not let Father Nathan speak. I’m so sorry the Council was rude to him and almost had him arrested. At NO POINT was Father Nathan ever rude or spoke out of line-his speech was eloquent, polite, logical. I wanted to hear him speak. Doesn’t mean I agree, but I still want to hear people say their view points. To Fr. Nathan, I apologize the city was so cruel to you-you deserve to be apologized to-and I admire you for standing up in your beliefs-so keep on doing what you do!
